<<Iran: The Death Sentence of Sharifeh Mohammadi, Turkish Labor
Activist, Overturned by the Supreme Court
The death sentence of Sharifeh Mohammadi, a Turkish labor activist, and
political prisoner held in Lakan Prison in Rasht, was overturned by the
Supreme Court and referred to another branch for reconsideration. She
had previously been sentenced to death on charges of rebellion (baghi).
According to a report received by the Hengaw Organization for Human
Rights, Amir Raeisian, in an interview with "Sharq Network," stated:
"After reviewing the case, the Supreme Court overturned my client Ms.
Sharifeh Mohammadi's sentence and referred the case to an equivalent
branch for reconsideration." Sharifeh Mohammadi, a labor activist
residing in Rasht, was sentenced to death in July of this year by Branch
1 of the Rasht Revolutionary Court, presided over by Judges Ahmad
Darvish Goftar and Mehdi Raskhi, on charges of rebellion through
membership in the Coordination Committee for the Formation of Labor
Organizations and <the affiliation of this organization to the Komala
Party.> This verdict was based on Articles 211 and 287 of the Islamic
Penal Code, passed in 2013. Earlier, Hengaw reported, based on a ruling
document in its possession, that <the national intelligence organization
is the only authority as an expert to identify members of groups, and
all reports from the Gilan and Kurdistan provincial intelligence offices
were attached to the case, identifying the defendant as a member of the
Komala Party and the Coordination Committee.> This reveals the lack of
independence in the Iranian judiciary and is clear evidence of the
security agencies' interference in the judicial system. It is worth
noting that the hearing for Sharifeh Mohammadi's charges was held on
Saturday, June 8, 2024, in Branch 1 of the Rasht Revolutionary Court.
This labor activist had previously been subjected to psychological and
physical pressure by interrogators from the Sanandaj Intelligence Office
to obtain a forced confession. Sharifeh Mohammadi was violently arrested
by intelligence forces at her home in Rasht on Tuesday, December 5,
2023, and has spent the past 10 months in detention in the central
prisons of Sanandaj and Lakan in Rasht, as well as in the intelligence
detention centers in these two cities.>>

<<Kurdish woman sentenced to imprisonment by Iranian judiciary
Zahra Sajedinia, a Kurdish woman from Bukan has been sentenced to 10
months of imprisonment by the judiciary of the Islamic Republic of Iran.
According to a report received by the Hengaw Organization for Human
Rights, Zahra Sajedinia, 38, was recently sentenced by Branch 101 of the
Bukan Criminal Court II on charges of <propaganda against the state.>
The ruling was officially communicated to her on September 29, 2024.
According to the verdict, Sajedinia has 20 days to appeal the court's
decision. It is worth noting that Zahra Sajedinia was arrested on
Wednesday, July 31, 2024, after being summoned to the Bukan Intelligence
Office. She was subsequently transferred to the intelligence agency's
detention center in Urmia. She was later released on bail, pending the
completion of judicial proceedings.>>

Lakan prison in Rasht to serve her three-year and six-month prison
sentence on Sunday.
News Center- Mahsa Jalal Badiei, a resident of Rasht was arrested and
transferred to Lankan prison in Rasht to serve her three-year and
six-month prison sentence on Sunday after being summoned to the Branch 5
of the Enforcement Office of the Revolutionary Court in Rasht. Mahsa
Jalal Badiei was arrested by Iranian security forces on May 13, 2024.
She was released on bail after six days in detention. She was later
sentenced by the Branch 3 of the Revolutionary Court of Rasht to three
years and six months in prison on charges of <propaganda against the
regime> and <conducting educational and promotional activities against
Sharia>.>>

Habibi
A Revolutionary Court in Iran has upheld the conviction of Mohammad
Habibi, spokesperson for the Tehran Teachers' Union, who had been
sentenced to six months and one day in prison by a lower court. Ramin
Safarnia, the labor activist's lawyer, announced the confirmation of the
verdict on X, stating, "This conviction is related to Mr. Habibi's
protest against the mass poisonings in schools in 2022." Between late
2022 and early 2023, 13,000 students suffered from symptoms including
nausea, fainting, headaches, coughing, breathing difficulties, and heart
palpitations, with many requiring hospital treatment. Hundreds of girls'
schools were targeted in what Amnesty International described as "a
campaign that appears to be highly coordinated and organized." The
poisonings sparked fear and anger among schoolgirls, their parents, and
wider Iranian society, leading to calls for increased security measures
at schools, with several principals reportedly asking parents to keep
their children at home. On April 5, 2023, just two months after being
released from prison, Habibi was arrested by the Ministry of
Intelligence for participating in teachers' protests against the school
poisonings. He remained in the security wing 209 of Evin Prison until
June of that year. Habibi, along with other labor activists, has been
arrested and imprisoned multiple times for his union activities and for
defending the rights of teachers and students. On January 10, he was
tried in the Shahriar Revolutionary Court on charges of <assembly and
collusion> for tweets and statements related to protesting the school
poisonings and defending students' rights.>>

The Islamic Republic's authorities have denied medical treatment for
Mahvash Sabet, a 71-year-old Baha'i prisoner suffering from pulmonary
fibrosis.
Despite the prison doctor's confirmation that she has lost part of her
lung function, they are also denying her medical leave. According to
information obtained by IranWire, a close relative of the prisoner
reported that despite the family's submission of several certificates
from specialist doctors stating that Sabet requires care from a
specialist, Evin prison authorities have ignored these documents. Sabet
developed a lung condition during her previous imprisonment. She served
a ten-year sentence from 2008 to 2017 on charges of being a member of
the governing body of the Baha'i community in Iran. Her illness worsened
after she contracted COVID-19 during her interrogation and inhaled smoke
from a fire at Evin Prison.
Sabet was arrested on July 31, 2022. The preliminary court sentenced her
to 10 years in prison on charges of leading an <illegal group with the
intention of disrupting national security.> In 2017, Sabet was
recognized as an International Writer of Courage by PEN International,
the literary freedom of expression group. She has also received a
prestigious literary award in Norway and was made an honorary member of
PEN in Austria and Denmar>>

The Islamic Republic's judiciary has sentenced two women journalists to
five years in prison each for their coverage of the September 2022 death
of Mahsa Amini while in custody. Asghar Jahangir, the spokesperson for
Iran's judiciary, announced the issuance of the five-year prison
sentences for Elahe Mohammadi and Niloofar Hamedi, two journalists
arrested following Amini's death. During a press conference on Sunday,
Jahangir provided updates on the case, saying, <These two journalists
were sentenced to one year in prison for propaganda activities against
the Islamic Republic and five years for assembly and collusion against
national security.> He added, <However, in the appeal court, they were
acquitted of the charge of collaboration with the hostile U.S.
government.> Jahangir explained, <Considering the issued verdict, the
heavier sentence (five years imprisonment) will be applied. Their case
has been sent to the relevant authorities for enforcement of the final
ruling.> In January, Hamedi and Mohammadi were released on bail from
Evin Prison after spending nearly 400 days in detention. The judiciary
said that both journalists were granted temporary release on $200,000
bail, pending an appeal of their sentences. Hamedi and Mohammadi were
arrested in 2022 shortly after reporting on Mahsa Amini's death.
Initially, Mohammadi had been sentenced to 12 years in prison, while
Hamedi had received 13 years.>>

Women's Ward
Restrictions on phone calls and in-person visits continue in the women's
ward of Evin Prison. Evin Prison officials, in a bid to intensify
pressure on inmates, have carried out unusual body searches.
Consequently, some prisoners in the women's ward have been denied
in-person and booth visits over the past few days. Political prisoner
Elaheh Fouladi has been deprived of contact and visits with her family
since July 6, 2024. Political prisoner Maryam Yahyavi has been deprived
of phone contact with her family since August 6. On August 3, the Evin
Prison authorities announced that dozens of these female prisoners would
be deprived of in-person visits with their families for an indefinite
period. The punishment followed the protest and sit-in by female
political prisoners in Evin Prison against the death sentence for
Pakhshan Azizi, on July 25 and 27, 2024, where they chanted slogans such
as "Death to the execution government," "Death to the dictator," "You
dictator, I am Arash, fire responds to fire," and "The women's ward of
Evin stands united and resolute to the end." Depriving a prisoner of
phone contact and in-person visits with family members violates several
provisions of the Universal Declaration of Human Rights.>>

Everyone", women discussed femicide, gender-based violence and the
patriarchal system and the struggle against them.

Women Weaving the Future and the International Justice Initiative for
Nagihan Akarsel, held a virtual panel entitled "Unite to Stop Femicide-Ensure
Justice for Everyone" with the participation of many women all around
the world. Providing Turkish, Arabic, English, Spanish and French
translations, the panel was moderated by Zilan Kurt. At the panel,
Nagihan Akarsel, journalist, academic, member of Jineology Academy and
editor-in-chief of Jineology Magazine who was killed by the Turkish
state in Sulaymaniyah on October 4, 2022 and other women killed by the
Turkish state, were commemorated. Women participating in the panel
discussed the increase in femicide cases all around the world and
underlined that the real perpetrators went unpunished. Femicide,
gender-based violence and the patriarchal system and the struggle
against them were also discussed at the panel. The women also stressed
that they aimed to raise awareness against the oppressive mechanisms,
gender-based violence, colonialism, racism and nationalism supported by
the nation-state system.>>

Prison
The death sentence of Ammar Asiyan, a law enforcement officer convicted
of the "premeditated murder" of a woman was carried out in Kerman
Central Prison. According to a report received by the Hengaw
Organization for Human Rights, in the early hours of Sunday, October 13,
2024, Ammar Asiyan, a first-class police officer from the village of
Targak in Dehdasht, Chaharmahal and Bakhtiari Province, was executed in
Kerman Central Prison. Sources reported that in October 2022, Asiyan
shot and killed a woman named Somayeh Mahmoudinejad with eight gunshots
in Qaleh Ganj, Kerman Province, after she rejected his demands. The
murder occurred in front of her eight-year-old child. Two months prior,
Asiyan had threatened to kill her if she refused his requests. The
court's sentence, issued by Kerman Military Court, included one year of
imprisonment, payment of blood money, and the cost of the noose for his
execution. During his detention, Asiyan had been held in the military
wing of Shahab Prison in Kerman.
As of the time of this report, the execution has not been announced by
government-affiliated media, particularly those linked to the
judiciary.>>

Opinion by the Cryfreedom.net outlet founder: Since months now the
mullahs' regime has been hanging dozens of inmates be it most of them
guilty of pre-medidated murder and or drugs-convictions. In those cases
I refuse to report about them because what they have done is absolutely
HARAM. But in a case as quoted up I make an exception because harming a
woman and whatever reason one might have it is HARAM too because no
excuse is valid for somebody to harm a woman. So in this case the
penalty serves the predator right. And may she rest in peace.

<<Kurdish Kolbar dies after days of suffering from fall in Iran's Border
mountains
Siamand Hasanpour, a Kurdish Kolbar (porter) from Sardasht passed away
after several days of hospitalization in Urmia. According to a report
obtained by the Hengaw Organization for Human Rights, on Thursday,
October 10, 2024, Siamand Hasanpour, a 37-year-old Kolbar from the
village of 'Aspameza' in Sardasht, died in a hospital in Urmia. A source
stated that last week, while attempting to escape border guards of Iran
in the Qandil border region, Hasanpour fell from a height and suffered a
severe brain injury. He had been in a coma since the incident.
It is worth noting that Siamand Hasanpour was married and the father of

Manizhe Khoshnoud, a Kurdish woman from Bukan, has been sentenced to 10
months of imprisonment by the judiciary of the Islamic Republic of Iran.
According to a report received by the Hengaw Organization for Human
Rights Organization, Manizhe Khoshnoud, 56, was recently sentenced to 10
months of imprisonment for <propaganda against the state> by Branch 101
of the Second Criminal Court of Bukan. The ruling was officially
delivered to her on Saturday, October 12, 2024. It is worth noting that
Khoshnoud was arrested on Wednesday, July 31, 2024, when security forces
raided her family home in Bukan without presenting a search warrant.
During the raid, the forces searched her home and confiscated her mobile
phone. After 37 days in detention, Khoshnoud was temporarily released on
bail on Thursday, September 5, 2024, pending the completion of her trial

Farzad Moazami Goodarzi, from Borujerd and the cousin of Reza Moazami
Goodarzi, who was killed during the November 2019 protests, has been
sentenced to five years of imprisonment by the Iranian judiciary after
six months of detention. According to a report received by the Hengaw
Organization for Human Rights, Farzad Moazami Goodarzi, a member of the
families seeking justice, was sentenced to five years of imprisonment by
Branch 29 of the Tehran Islamic Revolutionary Court, presided over by
Judge Ali Mazloum, on charges of <assembly and collusion against the
country's security.> Farzad Moazami Goodarzi was arrested by security
forces in Borujerd on Thursday, April 4, 2024, and was later transferred
to Ward 209 of Evin Prison, also known as the Ministry of Intelligence
detention center, where he has been held since. Farzad Moazami Goodarzi
had previously been arrested on Tuesday, September 5, 2023, by security
forces and was transferred to Borujerd Prison after two weeks. During
his first arrest, he was held for over a month and was eventually
released temporarily after posting bail.>>

Call for the release of Maryam Akbari and other political prisoners,
especially women
While Maryam Akbari Monfared's 15-year sentence as a political prisoner
ends on October 12, 2024, and she has spent the entire period in prison
without a single day of leave for medical treatment, the regime's
judiciary prevents her release by implementing additional sentences.
Maryam Akbari Monfared, one of the longest-serving female political
prisoners in Iran, should have been released in 2019 after serving 10
years in prison according to the regime's laws and regulations. As
stated in previous announcements by the NCRI Secretariat and the NCRI
Women's Committee, to prevent Maryam Akbari’s release, she was convicted
in two separate cases fabricated by the Ministry of Intelligence, with
two show trials held in Semnan and Evin, sentencing her to additional
prison time. One charge was <propaganda against the regime> and the
other included <insulting the leader [i.e Ali Khamenei], assembly and
collusion, spreading lies and disturbing public opinion, and inciting
people against national security.> Seeking justice for her siblings has
been this political prisoner's main <crime> for over a decade. Prof.
Javaid Rehman, the UN Special Rapporteur on Iran, wrote about Maryam
Akbari in his report on "Atrocity Crimes" in Iran published last July: "
One poignant example illustrating this pattern of harassment and
persecution is the case of Maryam Akbari-Monfared, a political prisoner
in the country. Ms. Akbari-Monfared displayed immense courage by filing
an official complaint from inside prison on 15 October 2016, addressing
the Iranian judiciary regarding the execution of her siblings during the
1988 massacre. In response to her pursuit of accountability, she has
faced increased pressure while incarcerated, including the denial of
visitations and her forced exile to a remote location, far from her
children... Despite enduring a 15-year sentence without a single day of
furlough, ... she was summoned to the Courthouse of Evin Prison and
arraigned on five new charges, subsequently receiving an additional
two-year sentence... her continued detention is aimed at coercing her
into renouncing her pursuit of accountability." In a vile and inhuman
action in July 2024, the regime’s judiciary issued an order to
confiscate the properties of Maryam Akbari and her relatives due to her
seeking justice for her three brothers and one sister who were executed.
The Women's Committee of the National Council of Resistance of Iran once
again calls on the UN High Commissioner for Human Rights, the UN Human
Rights Council, the UN Special Rapporteur on Human Rights in Iran, the
UN Special Rapporteur on Violence against Women, and other human rights
and women's rights advocates to strongly condemn the clerical regime's
inhumane treatment of political prisoners, especially women prisoners,
and to take immediate action for the release of Maryam Akbari Monfared.

<<Bail of 10 Billion Rials Set for Granting Leave to Mahmoud Sadeghi,
Kurdish Political Prisoner
Mahmoud Sadeghi, a Kurdish political prisoner from Kamyaran and
brother-in-law of executed political prisoner Heydar Ghorbani, is about
to enter his ninth year of imprisonment. He continues to be deprived of
his basic rights, and it has recently been announced that bail in the
amount of 10 Billion IRR has been set for granting him leave. According
to a report received by the Hengaw Organization for Human Rights,
Mahmoud Sadeghi, a Kurdish political prisoner held in Sanandaj (Sine)
Central Prison, has spent the last 7 years, 11 months, and 25 days in
prison without receiving any leave. A source close to the Sadeghi family
told Hengaw: "As Mahmoud Sadeghi approaches his ninth year of detention,
the security agencies have demanded an exorbitant bail of 10 Billion IRR
for granting him a few days of leave." Earlier, Hengaw quoted informed
sources as saying that the intentional non-merging of Sadeghi's two
imprisonment sentences has created ambiguity about the possibility of
granting leave. Mahmoud Sadeghi has repeatedly requested a transfer to
Kamyaran Prison, but due to obstruction by security agencies through
prison officials, he has been denied this basic right. In early March
2020, Mahmoud Sadeghi was sentenced to 25 years of discretionary
imprisonment by Branch 1 of the Sanandaj Islamic Revolutionary Court,
presided over by Judge Saeedi, on charges of <aiding in rebellion.> In
October 2019, he was sentenced to 30 years in prison by Branch 1 of the
Criminal Court in Kurdistan Province on charges of <aiding in murder and
collaboration with the Democratic Party of Iranian Kurdistan.> This
Kurdish individual was arrested on October 16, 2016, along with his
brother-in-law Heydar Ghorbani, an executed Kurdish political prisoner,
at his residence. After his arrest, he was held for three months in the
detention center of the Sanandaj Intelligence Office, where he was
subjected to psychological and physical pressure, and was eventually
transferred to Kamyaran Prison. After five months, he was moved to
Sanandaj Central Prison, where he remains to this day.>>

<<Varisha Moradi on an Indefinite Hunger Strike in Evin Prison
Kurdish political prisoner, Varisha Moradi, began an indefinite hunger
strike on Thursday, October 10, protesting the surge in death sentences,
the continued extension of her detention, and her denial of visitation
rights with family and legal representation. It has been nearly a year
since the political prisoner Varisha Moradi was arrested and placed in a
state of uncertainty. Her first court session was held on June 16, 2024,
in Branch 15 of the Tehran Revolutionary Court, presided over by Judge
Abolqasem Salavati. The charges against her include armed insurgency (Bagh-ye)
and membership in opposition groups against the regime. Since mid-May
2024, Varisha Moradi has been deprived of in-person meetings and phone
calls with her family and lawyer. This illegal action has put additional
psychological pressure on her, indicating the authorities' efforts to
break her spirit.
In the Sunday, June 16, 2024, court session, the judge did not allow her
lawyers to defend their client. This move is a blatant violation of the
legal rights of the prisoner and highlights the oppressive behavior of
the Iranian judiciary. The second court session addressing the charges
against Varisha Moradi was held on October 6. Varisha Moradi is a
women's rights activist and a member of the Free Women's Society of
Eastern Kurdistan (KJAR). She was abducted on August 1, 2023, in
Kermanshah, on her way to Sanandaj in western Iran. She was transferred
from the Sanandaj Intelligence Department detention center to Ward 209
of Evin Prison by the end of August. On December 26, 2023, after the
interrogation process was completed, Moradi was transferred to the
women's ward of Evin Prison. Varisha Moradi, who is originally from
Sanandaj, was charged in January by the Fifth Investigative Branch of
the Tehran Public Prosecutor’s Office. Her case was then referred to the
15th Branch of the Tehran Revolutionary Court on charges of <armed
rebellion> for membership in an opposition group. According to reports,
Varisha spent the first five months of her imprisonment in solitary
confinement in the detention center of the Intelligence Department in
Sanandaj and in Ward 209 in Evin Prison, where she was severely tortured
to make false confessions against herself. The indefinite detention of
prisoners without due process is a severe human rights violation,
breaching Articles 9 and 14 of the International Covenant on Civil and
Political Rights. Under international human rights laws, every detained
individual has the right to be promptly informed of the reasons for
their arrest and to receive a fair and timely court appearance.>>
