Can National Unity Pave the Way for Transitional Justice in Iran?
In the wake of President Masoud Pezeshkian's claims for the formation of
a <National Unity> government and repeated emphasis on achieving
national unity to preserve and save Iran, a critical question arises:
Can it pave the way for transitional justice? Moreover, is there a
connection between national unity and transitional justice, and whether
one is a prerequisite for the other? Zahra Rahnavard, former president
of Al-Zahra University in Tehran and a prominent figure in the Green
Movement who has been under house arrest, responded to the proposal for
forming a national unity government in an open letter. She emphasized,
"National unity requires the recognition of equal rights for all
citizens and their effective participation in shaping the country's
political, economic, social, and cultural destiny." Rahnavard
highlighted the widespread violation of women's rights, stating, "With
the formation of the National Unity Cabinet, we must remember that the
suppression and deprivation of women's human rights, freedom, justice,
and the ability to choose their destiny in both private and public life
continues unabated." She argued that addressing these injustices is a
prerequisite for national reconciliation, which can only be achieved
through transitional justice.
Transitional Justice as a Mechanism for National Unity
Transitional justice entails a range of judicial and non-judicial
strategies to address widespread human rights abuses and guide societies
from periods of conflict to peace, democracy, human rights, and the rule
of law. Its objective is to hold perpetrators accountable, promote
national reconciliation, prevent the recurrence of conflict, and
establish sustainable peace while transitioning to democracy and
embedding human rights and legal norms. The successful implementation of
transitional justice hinges on the transition from dictatorship,
violence, and repression. Without justice being served for the victims
and violators of human rights, cycles of violence and revenge can
persist, potentially leading to renewed tyranny.
A robust federal mechanism for transitional justice is essential for
achieving national unity. Peru's journey to transitional justice
provides valuable insights.
Peru's Experience with Transitional Justice
For two decades, from 1980 to 2000, Peru faced a harrowing period of
armed conflict, government repression, and widespread human rights
violations. However, the turning point towards transitional justice came
not from the violence but from the exposure of systemic corruption under
President Alberto Fujimori. In 2000, public outrage over government
corruption and economic hardship led to mass protests. Fujimori fled the
country and resigned from the presidency, setting the stage for a
transitional period. This transition allowed international legal
institutions to intervene and implement mechanisms for transitional
justice. Following Fujimori's departure in September 2000, a power
vacuum ensued. The transitional justice process was officially initiated
in June 2001. The Peruvian government established the Truth and
Reconciliation Commission (TRC) to investigate serious human rights
abuses and provide redress to the victims. One of the primary goals of
the TRC was to address the deep-rooted social, economic, geographic, and
educational inequalities that had fueled decades of political violence
in Peru. The commission aimed to compensate victims and implement
measures to prevent similar tragedies from occurring in the future. With
Fujimori's escape and the removal of corrupt military officers, a
transitional government was formed under President Valentín Paniagua.
During this interim period, the government focused on prosecuting human
rights violators and investigating corruption. Despite its short
duration, the transitional government successfully restored democratic
institutions, reinstated the rule of law, and prioritized respect for
human rights. Moreover, the Paniagua government worked to reestablish
Peru's position in international treaties, such as the Inter-American
Convention on Human Rights and the International Criminal Court, while
overseeing free and fair elections. The transitional justice process in
Peru went beyond criminal prosecutions. The TRC spearheaded national
reconciliation efforts, encouraged dialogue, and set up an
inter-institutional commission to compensate victims. The commission
also pursued Amnesty for political prisoners and initiated a
"truth-seeking" investigation to uncover the underlying causes of
violence and identify those responsible for human rights violations.
Key Objectives of Transitional Justice
Several nations, including Colombia, Guatemala, Mexico, and Panama, have
grappled with violence and have turned to transitional justice
mechanisms to move from conflict to peace. While some call this process
the "transition to democracy," transitional justice encompasses more
than just democracy and involves a clearly outlined procedure. The
approach and execution of transitional justice vary across countries,
shaped by each society's unique culture, the collaboration of diverse
social groups, and the prevailing economic, social, and political
conditions. While specific actions may differ, transitional justice
generally includes the following:
Prosecution of Offenders: Perpetrators of human rights violations are
often prosecuted in international courts, such as those established by
the United Nations, for crimes against humanity and war crimes.
Compensation for Victims: Victims may receive financial reparations or
symbolic gestures like official apologies, the construction of
memorials, and public recognition.
Structural Reforms: Reforms in institutions such as the police,
military, and judiciary are essential to preventing future human rights
violations and holding perpetrators accountable.
Fact-finding Commissions: These commissions investigate patterns of
abuse and identify the root causes of serious human rights violations,
providing recommendations for the future.
Temporary Institutions During Transition: Legal, judicial, or political
temporary institutions are established to aid the justice process and
facilitate the transition to peace and democracy.
Peru's Transitional Justice: Progress, Challenges, and Hope
Following the formation of the Truth and Reconciliation Commission, Peru
managed to break free from its history of violence and armed conflict.
However, long-standing issues like discrimination and inequality
persist, and the progress of civil society organizations focusing on
economic, social, cultural, and environmental rights has been slow.
Despite these challenges, several accomplishments stand out.
Transitional justice in Peru has seen the condemnation of widespread
human rights violations and prosecution of violators, revision of unjust
judicial rulings, identification of victims, and establishment of a
compensation plan. Peru has also witnessed the creation of memorials for
victims and the promotion of a culture of tolerance, the growth of
academic research and artistic efforts addressing the nation’s violent
past, the institutionalization of human rights culture within law
enforcement and defense institutions, improved access and social
inclusion in education, and extensive support campaigns for residents of
marginalized areas.
Lessons from Around the World
While not fully achieving a democratic transition or establishing equal
citizenship, transitional justice in Peru has significantly transformed
a country with a long history of discrimination and inequality. Public
culture, societal cooperation, and readiness for reconciliation
influence the success of transitional justice. While international
courts address severe human rights violations, the most impactful aspect
of transitional justice is promoting tolerance and compromise within
society. As Iran grapples with its own history of human rights abuses
and political turmoil, the lessons from Peru's experience provide
valuable guidance.>>
